In the First Amended Complaint, removed to this Court from the Medina County Court of Common Pleas on March 16, 2009, Plaintiff Soprema alleges breach of contract claims, unjust enrichment claims and conversion claims in connection with a roofing project. Plaintiff Soprema is an Ohio corporation that supplies roofing materials for construction projects. Defendants Beachside Roofing, L.L.C. (“Beachside”) and Bodell Construction Company (“Bodell”) are roofing contractors that install Soprema’s products per their Authorized Roofing Agreements with Soprema.

The Plaintiff’s claim stems from alleged defective workmanship in the repair of the roofs at the Queens’ MarketPlace construction site. The alleged faulty work caused water leaks in buildings at the construction site. The parties reached an agreement to remediate the leaks and Defendants have incurred testing, supervision, and inspection fees in attempting to accomplish those repairs.

Defendants argue that the Court lacks personal jurisdiction over this matter because the dispute arises from events that occurred entirely in Hawaii. However, Defendants’ own affidavits reveal continuing contacts between the parties in the form of purchase orders and payments and contact with each other concerning the alleged faulty work in Hawaii. Furthermore, the Court finds that the alleged defective work and the parties’ efforts to remedy that faulty work occurred in Hawaii and Defendants routinely traveled to Hawaii for the purposes of their roofing contracts with Soprema.
